Positive FX Counseling & Wellness, PLLC (“the Practice”), operated by June Pittman, MS, LMHC, is committed to protecting the privacy and confidentiality of all clients and website visitors. This policy describes how we collect and use information, your rights under applicable law, and how to contact us with questions or concerns.

Protected Health Information (PHI)

As a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), the Practice is required to maintain the privacy of your Protected Health Information (PHI). PHI includes any information that identifies you and relates to your health condition, treatment, or payment for healthcare services.

We will not use or disclose your PHI without your written authorization, except as permitted or required by law. Permitted uses include:

• Treatment: sharing information with other providers involved in your care with your consent
• Payment: submitting claims to your insurance company
• Healthcare operations: activities necessary to run a compliant practice
• Mandatory reporting: imminent risk of harm to yourself or others, suspected abuse of a minor or vulnerable adult, or a valid court order

Website Information

When you visit this website, we may collect non-identifying information such as browser type, pages visited, and general geographic location through standard analytics tools (Google Analytics). This information is used to improve the website and understand how visitors engage with its content. It is never sold to third parties.

Contact form submissions are transmitted via encrypted connection and are used solely to respond to your inquiry. They are not shared with any third party except as required by the email and scheduling platforms used to operate this practice.

Telehealth and Electronic Communications

All telehealth sessions are conducted via a HIPAA-compliant, encrypted video platform covered by a signed Business Associate Agreement (BAA). Sessions are never recorded without your explicit written consent.

Email and text communications between sessions are not considered a secure channel for sensitive health information. Please limit communications through these channels to scheduling and administrative matters.

Third-Party Services

The Practice uses Headway for billing and insurance processing, which maintains its own HIPAA-compliant privacy practices. By using insurance benefits, you authorize the sharing of necessary billing information with your insurer. You may review Headway’s privacy policy at headway.co/privacy.

Your Rights

Under HIPAA and Florida law, you have the right to:

• Request a copy of your health records
• Request corrections to your records
• Request restrictions on how your information is used or disclosed
• Receive an accounting of disclosures made without your authorization
• File a complaint with the U.S. Department of Health and Human Services or the Florida Department of Health
